The General Conditions of Sale define the conditions applicable to sales concluded between, on the one hand, persons making a purchase via the NCMG SAS website www.nuvees.com, hereinafter referred to as "the Customer" and, on the other hand, the company. NCMG SAS, hereinafter referred to as “Nuvées”. These conditions apply exclusively to non-commercial individuals.

I / Price of items and Order


All prices are indicated in euros all taxes included, excluding shipping costs (see paragraph Shipping and Delivery)

The prices of items offered on Nuvées are valid for 24 hours from their publication on the site www.nuvees.com. The items will be invoiced on the basis of the rates in effect at the time of order entry. They remain the property of Nuvées until full receipt of the price by Nuvées.

The Customer will be able to view during these different stages the details of his order and its total price and correct any errors, before confirming it to express his acceptance. The Customer will receive an order confirmation email. Nuvées retains ownership of the items until full payment of the order, that is to say, receipt of the price of the order by Nuvées. Nuvées reserves the right to cancel or refuse any order from a Customer with whom there is a dispute relating to the payment of a previous order or who would present in its eyes any form of risk.

Any order implies acceptance of the prices and description of the items available for sale. Nuvées undertakes to honor orders received on the website only within the limits of available stocks. In the absence of availability of one or more item (s) ordered, Nuvées undertakes to inform the Customer as soon as possible, and if necessary to reimburse him at the latest within 14 days following the date. to which he has exercised his right of withdrawal. The Customer's order will then be automatically canceled.

Nuvées reserves the right to verify the personal data communicated by the Customer and to adopt all measures deemed necessary to verify that the person who placed the order is indeed the holder of the Customer account and / or the means of payment. used, in order to avoid any identity theft or fraudulent payment.

II / Shipping and Delivery

Same day shipping:

Nuvées aims to guarantee you the best delivery times so that you can have your products quickly.

Except in exceptional cases, Nuvées ships all orders placed the same day:

  • By express, the next day before 1 p.m. at home with Chronopost 13 (except Sunday): € 10.

The times indicated are those of the delivery time. We normally ship orders placed before 3 p.m. the same day. However please see the "Same Day Shipping" section below for more information.

In the overseas departments and regions (DROM) + New Caledonia:

  • At home with the Post Office: € 7

The product is sold HT (20% less than the displayed price). The customer will however receive an invoice from the Post Office, with the costs related to the importation of the product (local VAT + Sea fees). This amount, which may vary slightly depending on the destination, is approximately equivalent to the amount of French VAT (20% of the total price).

    In the rest of the European Union (except France, Belgium, Luxembourg) + Switzerland:

    • At home with the Post Office: 8 €

        Condition of the package on delivery:

        The Customer is required to check the condition of the items delivered. Any anomaly concerning the items (damage, item missing from the purchase order, damaged or open package, broken item, etc.) must be indicated within 3 days of delivery.

        Fight against credit card fraud

        Nuvées reserves the right to verify the personal data communicated by the Customer and to adopt all measures deemed necessary to verify that the person whose bank account is debited is indeed the one who placed the order, in order to avoid any fraudulent payment. This verification may take the form of a request for proof of identity and / or address. The Customer's failure to respond to a request of this type within 2 days of the request made by Nuvées will automatically result in the cancellation of the order concerned, without any possibility of subsequent complaint.

        Nuvées will also be free to directly cancel an order that presents one or more risk factors for fraudulent use of a bank card.

        IV / Exchange, return and refund

        You have the right to withdraw from this contract without giving any reason within fourteen days of receipt of the product. To exercise the right of withdrawal, you must notify us of your decision to withdraw from this contract by means of an unambiguous statement (for example, email or letter sent by post). In order for the withdrawal period to be respected, it is sufficient that you send your communication relating to the exercise of the right of withdrawal before the expiry of the withdrawal period.

        Effects of withdrawal:

        You must return or return the goods without undue delay and, in any event, no later than fourteen days after you have communicated your decision to withdraw from this contract to us using the original invoice. This period is deemed to have been met if you return the goods before the expiration of the fourteen day period. We do not bear the cost of returning the goods.         b / Return

        At Nuvées the Customer has 14 days from the date of receipt of the items to inform us of their desire to return the items. For all purchases, return shipping costs are free if the package is returned from mainland France, Belgium or Luxembourg. In other cases, the return shipping costs are the responsibility of the customer.

        This right of return within 14 days does not limit the legal rights and guarantees.

        Item condition:

        All returned items must be returned perfectly intact in their original packaging and with the original labels.

        Upon receipt of the package, Nuvées will judge the perfect condition of the returned merchandise. No return will be accepted if the returned items have been visibly used or damaged by the Customer and this use or damage renders the items unfit for sale.

        Process and conditions of return for refund

We will reimburse you for all payments received without undue delay and, in any event, no later than fourteen days from the day we are informed of your decision to withdraw from this contract. We will refund using the same payment method you used for the initial transaction, unless you expressly agree to a different method; in any case, this reimbursement will not incur costs for you. No cash refund will be made by Nuvées in the event of the return of one or more items paid for by gift card. The corresponding card will be automatically re-credited with the corresponding amount by the partner concerned.

          Return of the right product

          The Customer must return the product purchased on the site to uswww.nuvees.com, new and unworn, for which he has exercised his right of withdrawal or his return request. If the Customer does not return the correct product, Nuvées will send him an email inviting him to collect it at his expense, within two months of the date of the email. After this period, Nuvées will consider itself owner within the meaning of article 2276, paragraph 1 of the Civil Code which provides: "In matters of furniture, possession is equivalent to title. ".

          In addition, in the absence of return of the goods subject to the right of withdrawal, Nuvées will reserve the right to lodge a complaint for breach of trust (article 314-1, paragraph 2 provides that: "Breach of trust is punishable by three years.           VI / Guarantee

          All the items offered by Nuvées are subject to the legal guarantee provided for by articles L 217-4, et seq. Of the Consumer Code and to the guarantee against hidden defects provided for in articles 1641 et seq. Of the Civil Code.

          The Customer has two (2) years to exercise any of these guarantees. For the lack of conformity, the period starts from the issue. For hidden defects, the period starts from the discovery of the defect.

          If the apparent defect, the lack of conformity or even the hidden defect of the item, declared by the Customer, if applicable, is proven, after an expert report has been carried out, Nuvées may proceed to repair or replace the Product. If this is not possible, Nuvées reserves the right to reimburse the Customer at its expense.

          However, Nuvées cannot be held responsible for the misuse and / or intensive use of the items that the Customer may make of them. Likewise, Nuvées cannot be held responsible for the return of a competing product and / or not sold on the Site by the Customer. It is the Customer's responsibility to return the correct item.

          Nuvées does not offer any commercial guarantee.

          VII / Responsibility

          Nuvées is fully responsible to the Client for the proper performance of the contract concluded with the Client. However, Nuvées cannot be held liable for the non-performance or improper performance of the contract concluded in the event of force majeure, the occurrence of an event attributable to the Customer or any inconvenience, unforeseeable and insurmountable damage inherent in the use. the Internet network, in particular a break in service, an external intrusion or the presence of computer viruses. Nuvées cannot be held liable for the content of these websites if they contravene the legal and regulatory provisions in force.

          VIII / Retention of title

          Nuvées remains the owner of the goods until full payment of the price by the Customer.

          IX / Intellectual property

          All texts, comments, works, illustrations and images reproduced on Nuvées are reserved under copyright as well as intellectual property and for the whole world. As such and in accordance with the provisions of the intellectual property code, only use for private use is authorized, subject to different or even more restrictive provisions of the intellectual property code. Any total or partial reproduction of the Nuvées site is strictly prohibited without prior agreement.

          X / Mediation

          According to articles L 611-1 et seq. Of the Consumer Code, the Customer has the right to have recourse free of charge (except for possible legal and expert fees) to a consumer mediator with a view to the amicable resolution of a litigation opposing it to NCMG SAS. Since February 15, 2016, the European Commission's amicable dispute resolution online platform has been open to the public.           XI / Applicable law

          These general conditions of use and sale are subject to French law. In the event of a persistent disagreement on the application, interpretation and execution of these presents, and in the absence of an amicable agreement, any dispute will be subject to the competent French courts.
